Too many people win an online game

An IT consulting firm was asked to manage an online game for a famous brand of mineral water including a hundred prizes worth €3,720.00.

THE CONTEXT

An IT consulting firm was asked to manage an online game for a famous brand of mineral water including a hundred prizes worth €3,720.00. The game was to last several months and the prizes were to be awarded one after the other. A change in the code developed by the firm resulted in an excess number of prizes being awarded.

Considering that it was obligated to honour all winners, the company marketing the mineral water claimed the costs resulting from the excess number of winners from the consulting firm.

GM CONSULTANT INTERVENTION

Intervening at the request of the IT consulting firm’s insurers, GM Consultant’s loss adjusters conducted the technical and financial analysis of the case.

In a joint appraisal meeting to which it had been summoned, GM Consultant raised the fact that the claimant had accepted the implementation of the code changes without carrying out the acceptance test for which it was responsible.

After several exchanges of technical notes with the claimant’s loss adjuster, the latter finally withdrew its claim of €650,000, recognising the merits of GM Consultant’s position.

This case strengthened the collaboration between the insurer and the IT consulting firm and favoured the involvement of the company and GM Consultant from the early stages of disputes, which had not been the case previously.
