Refusal for a load of hydrochloric acid

A manufacturer of hydrochloric acid contracted a Portuguese haulier to transport 20 tonnes of acid from its factory to the end customer’s premises.

A sample was taken during delivery and the customer noticed that the product was the wrong colour. The customer then refused to accept delivery.

Our loss assessors were dispatched a few days later, while the Portuguese driver was still stuck in France with his lorry.

We discovered that the pollution was the result of the tank being poorly washed by the cleaner. We also sold the product for scrap to avoid paying to park and then destroy tank, estimated at €8000 excl. VAT (four times the price of the product).

Once the tank had been emptied, the driver was able to continue his journey.
