Crack in the arm of a forklift


A logistics company which used a large number of forklifts in its warehouses had hired equipment from a specialised company.

However, one of the forklift had a defect in the telescopic arm. The lessor had blamed the damage on incorrect use of the equipment.


The observations made by the GM Consultant loss adjuster contradicted this opinion and concluded that there was a manufacturing defect in the arm. More specifically, the arm had been welded incorrectly.

As the lessor did not agree with this technical conclusion, a judicial expertise procedure was launched.
The court-appointed expert also concluded that the welding had been carried out incorrectly. As a result, the lessor lodged an appeal against the supplier of the forklift.
